An NGO is a registered organization initiated by private individuals which function independently without government intervention. The government uses the term " NGO " to denote that these entities do not hold official status.   • A company registered under NGO Registration guarantees limited liability to its members. The members' roles and responsibilities are restricted to the extent of their capital or fund contribution. Although the company enjoys all the benefits of a corporate entity, it cannot be named as such by adding the suffix "Limited" or "Private Limited" to its title.

There are three Legal possible ways for NGO Registration Online in India

Registration of Trust is carried out according to 'The Indian Trust Act, of 1882'; Society Registration is done as per 'The Societies Registration Act, 1860', and Section 8 Company Registration is done per 'The Companies Act, 2013'.

Documents required for NGO Darpan New Registration in India

Trust Registration

The following documents are mandatory for NGO Trust Registration under 'The Indian Trust Act, 1882':

  1. A water or electricity bill indicating the address to be registered.
  2. Identification proof of at least two members of the organization, which can be:
    • Driving License
    • Voter ID
    • Aadhaar Card
    • Passport

Once the registration fee is paid, it takes approximately 8 to 10 days to complete the online trust registration process as per the norms of the Indian Trust Act – 1882. Before the legal document becomes valid throughout the country, the applicant must submit a presentation at the corresponding registrar's office.


 

Stepwise Process for NGO Darpan New Registration in India

Step 1: Fill out the NGO Registration Form, which requires providing all the necessary details in a simple application form.

Step 2: Gather Prerequisite Details, where you must collect all the required documents according to the specified requirements. This step takes approximately 2 working days.

Step 3: Prepare a Trust Deed, where the documents provided by you will be used to create a Trust deed. This process usually takes around 4 to 5 working days.

Step 4: Trust Deed Registration process, where the compiled Trust deed will be submitted to the concerned local registrar for registration. This step typically takes around 12-13 working days to complete.

Step 5: Granting of NGO Registration Certificate, where upon completion of the Trust NGO registration process, the registered Trust Deed will be sent to you via courier.

The procedure of NGO Registration - Society Registration

To register a society, the following documents are required:

  • The name of the society
  • Proof of address for the registered office
  • Identity proof of all members of the society, which can be: a copy of an Aadhaar card, passport, driving license, or voter ID
  • Two copies of the Memorandum of Association (MOA) and By-laws that conform to the specified norms for society registration

Once the processing fee is paid, it takes around 8 to 10 days to draft the MOA and By-laws of the society. The society registration process takes about 21 to 30 days to complete.

The procedure of the Society Registration Process

The Societies Registration Act of 1860 governs registering of an NGO as a society in India. To register an NGO as a society, two crucial documents are required: a Memorandum of Association and Rules and Regulations of the Society. 

The Memorandum of Association can be drafted by filling out the following six clauses:

  1. Name Clause
  2. Objects Clause
  3. Liability Clause
  4. Domicile Clause
  5. Subscription Clause
  6. Capital Clause

Procedure for NGO Society Registration Online in India

Step 1: Fill out the NGO application form by providing all the details in the online application.

The Registration Process of Section 8 NGO

The process of registering a Section 8 NGO in India is similar to any other entity registration process. To complete the process, directors and their digital signature certificates along with the Memorandum of Association (MoA) and Articles of Association (AoA) are required. Here is a step-by-step procedure for the registration process of a Section 8 Company.

Step 1:

To register a Section 8 Company, complete the online application form with all the required details.

Step 2:

Obtain the Digital Signature Certificates (DSC) and Director Identification Numbers (DIN) for all directors, and apply for Section 8 Company name approval.

Step 3:

The concerned experts will verify and check the submitted information to approve the company name.

Step 4:

Draft the rules and regulations for your Section 8 Company, which will be included in the NGO trust registration online.

Step 5:
